I don't think that "charged for" or "free"  is the issue.
I think that there should be no "ties" or "encumberances" in the IP or 
patent sense,
other than the GPL.

I think we need to keep an eye open for a potential attack through the 
US Legal system
(which is amoral)  where victory goes to the biggest bully who can 
afford to go to appeal
repeatedly until his victim is bust.
