Hmm, well if you have permission from the author of the material (either
explicitly or by compliance with some license) then you may reproduce
their material, if no however then you would be a copyright infringer
and thus in breech of the contract (either implied or explicitly defined
by a license) between you and the author.

If the author places their own material into your system then they
implicitly agree to it's use in that manner.  You may wish to formally
get authors to tick a box on your CMS to state that they agree to those
terms (or indeed they agree to publish their work under the FDL).
