It won't get that far though because if someone cares enough about a
libel issue to send a proper take down notice (which is still just
their opinion) then you have to obey it or else begin to mount a
defence, for which there is no legal aid.  Who's paying?

So my point is that if you believe what you say about the sacrosanct
nature of your list archives then you can either rely on deep
pockets or wide scale distribution.  You can't rely on the
well-meaning nature of your service provider, because their hands
are probably financially tied.

But yes, the first step as you say is securing non-revocable
permission to publish in the first place..
