Well technically, in the same way that it is technically illegal to
eat mince pies on Christmas day, illegal to impede a pregnant woman
peeing (even onto your private property) and so on. I think a
prosecution would have a pretty low chance of success due to the long
period of acquiescence. When a majority of people are doing something
then eventually its democratic mandate wins out, even despite the
collusion between the music companies and the politicians.
