A little bit complicated that one. A few questions spring to find:

1. GPL version? (GPLv2, GPLv2+, GPLv3)

2. Is the product a derivative work?

3. Is the product distributed to the public?

4. Is the charge reasonable?

5. How is the source code of the product licensed?

6. Is the product distributed as a binary or as a set of patches?
