I think it's worth being clear on this. 

SCO are not trying to use patents or copyright for this. On either score 
they would have no case, even under the madness of US law.

What they are doing is claiming "trade secret" infringement and under US 
law that is a well recognised way to destroy others. While the law 
generally recognises the freedom of individuals to keep using their skills 
in the US it seems that it also allows previous employers to attack a new 
employer (and former employees) with this method at the same time.
