It was supposed to be new and the manufacture date printed on the drive is
13th Oct 2003 so even now, long after the failure it should still be in
warranty. The maxtor website gave the warranty end date as being 3 months
from date of manufacture.

I've seen this sort of thing before when I used to work in retail (TV &
other brown & white goods) the retailer chooses to "buy out" the warranty,
take the responsibility for fixing/ replacement in turn for a lower
wholesale price. The place I worked did this as they had a decent workshop
and always supplied with a 5 year waranty anyway. It was common for us to
negotiate a 12 month warranty down to a month or two for a lower price,
always worth having a month or two to cover "infant mortality" type
problems.

I long ago gave up trying to trace the trader and chalked it up to
experience, I just wanted to pass on the warning about checking warranties
rather than assuming/ hoping that 12 months was always the case.
