It is quite an interested set of developments really.  The fearfulness 
of the antivirus vendors is interesting, from an article by Bruce 
Schneier on wired.com:

"The company [McAfee] admits on its web page that this is a lousy 
compromise. "McAfee detects, removes and prevents reinstallation of 
XCP." That's the cloaking code. "Please note that removal will not 
impair the copyright-protection mechanisms installed from the CD."

Could the Anti-virus vendors fear prosecution under the DMCA for 
providing a tool to bypass a copy protection mechanism?
