Current laws derive from the EU "Directive on Privacy and Electronic
Communications" which was implemented in UK law as the "Privacy and
Electronic Communications (EC Directive) Regulations 2003".

The latter statutory instrument is implemented by the Information
Commissioner (ICO, http://www.informationcommissioner.gov.uk/).

Unfortunately it has to be said that the EC Directive and the UK laws
are big on what companies shouldn't do, but not on what the penalties
are for breaking them.  We advise companies on how to stay on the
right side of the law, but it's sometimes hard to persuade them when
there isn't much of a penalty for them breaking or ignoring it.

The Information Commissioner can apply an enforcement notice in cases
where there have been breaches.  You can find out more on the ICO
website.
