I would have thought that not giving up your passphrase was a "contempt of court." They -
the court usually give you a short sentence - then bring you back to the court and ask you
again.
A two year sentence straight off seems to me to be a bit excessive - a judge can either fine
you - but he can't keep sending you back to jail. On a positive note: without your
passphrase the "authorities" can not "crack" the encrypted data. So - far from being in a
strong position - there is no real strength in threats of a jail sentence - you can sit it
out and wait - the "authorities" are in a very weak position - they find it impossible to
decrypt your data. That gives us strength.
In the 70's MI6 used to take you down to Aldershot - where they would roll you up in a
blanket and bit the shit out of you - then leave the lights on 24 x 7 and then water-board
you. They would then march you about jammed between to big army guys to interrogate you. I
think a week of that then you will give up your passphrase :)
By and large MI6 is filled with university graduates - but it's the army bods you have to
worry about - middle-class values do not apply!!
