I'd certainly not do it against Microsoft, the way they pour money into
litigation you simply wouldnt stand a chance.
Against a small business, well yes you probably would get away with it, they
may neither care, notice or not have the financial resources to do anything
about it.
I know for example that there are a couple of other companies using the
Infolink name, though we are actually the one longest registered with
companies house, and a few do something vaugely similar to what we do, so in
theory I might get them to change their names, but I simply can't be
bothered. Main issue I had was there used to be a credit reference agency
called Infolink, they were taken over a few years back by Experian and
directory enquiries decided to always give out my direct number instead!
