They filed for that patent on the 6th December 1996....

The fact that others have been doing it in between filling and award doesn't
stop it being granted. Indeed, a key difference between the US Patent system
and the UK one is that, in the US, you're allowed to RELEASE an "invention"
and still apply for a patent up to a year after the information you released
went public... in the UK, you have to file first.
