Depends on the evidence doesn't it. If a ISP claimed you were downloading
kiddie porn (are there any ISP's that actively check this) then they would
have to produce evidence that not only was it your account but also that it
was you that did it. Such dodgy material being on your hard drive is strong
evidence but again not conclusive you did it.

If carrying the material over a network was a crime then ISP's, Transit
Providers, Telcos et al would all be out of business. Most of all the high
profile kiddie porm cases have been from info passed from the feds in the US
about people stupid enough to use their credit card on porn sites.
