Yes the image of Tux is copyrighted, however you have free license to use the image how every you choose, providing you acknowledge Larry Ewing.

All penguins look very similar ;) [1]
The two are different in that Tux is supposed to be featured in full, sitting like he's had a plate full of fish and is well sated [4]. The freemobilestuff one really only feature the head, or the very least a pair of googly eyes. They are too different to be worth pursuing.
