Sounds like something is holding onto /dev/dsp. When you get the
problems try "lsof /dev/dsp" to see if anything has got hold of it and
then "killall -9 [application name]" to remove it.
You should probably look at moving away from ESD to ALSA/DMIX for sound
anyway. I believe someone posted a quick howto on the list about it, and
I know there is a guide on the Ubuntu forums.
