Why WEP rather than WPA?

Is there not possibly an argument that says you might be on legally safer
ground if it's blatently insecure rather than pretending to be secure.  A
fully open network at least has a plausible defence that it was someone else,
whereas a pseudo-secure network might make people think it was impossible.
