Ah ha; that's my downfall, thinking I can resolve all my issues by surfing the net instead of talking to a real person.
I found an article on the BBC website about a consumer who fought for a refund by not accepting the EULA, think I'll have a chat with Dell first with plan B up my sleeve - http://en.wikipedia.org/wiki/Windows_refund
