About 5 years ago there was a furor when a major government IT contract 
collapsed - it may have been one of the payments systems but I cannot 
remember and the government stated that they could not withold payment as 
without the good will of the major consulting firm the system would not be 
made to work at all.

Penalty clauses are rarely enforced by .gov as they are over a barrel with 
the large consulting firms.
