The code is still there - probably because they don't have anyone that's 
  capable of re-writing it (I know, because I'm an ex-microserf - never 
though I'd admit that here!).  I was also under the impression that the 
BSD licence rather restricted other use of their code.

They don't need to steal it anymore - they just litigate the hell out of 
anyone who crosses their path (I know - it's why I'm an ex-microserf!).
