Well, if you want somebody to host your email other than doing it
yourself, you've got to trust somebody. What's to stop the police
here in the UK applying for court orders to get access to information
your service provider may have about you, or to get access to
mailboxes, etc?
I've been using Google Apps (and therefore Gmail) for the past five
years generally without incident (my biggest problem has been with
their support - they're not a people company and even now it's still a
bit "talk to the hand") - certainly I've never experienced loss of
email data, nor (to my knowledge) have had my details passed to third
parties by Google without my knowledge or permission. Since I pay
Google for my Google Apps account I don't have any targeted adverts
within Gmail.
If you did want to host your own mail server with Gmail-like
functionality, you could take out a 2Gb VPS and run Zimba Open Source:

It's quite nice and quite straight forward to set-up.
