Is the name being used at all?
Is the current ISP actually making any money from it?
I think the problem here is unless you are actually losing out on money as a 
result there is nothing really to be gained by legal action. If YOU paid for 
the registration, I think it's just a matter of taking it up with the 
registrar and asking them to correct the entry. I've done that with nominet in 
the past.
