I wish/hope you're right, but I have little faith :-|

Since windows insists the user to accept the EUL"A" upon the first
boot[1], you may well be right. What would be the point of the
first-boot EULA otherwise?  But if you accept *that*, you're trapped.
Refuse it, and you *should* be able to get a refund.

[1] At least my laptop which came with Windows ME (Dell wouldn't sell me
a laptop without windows, and ME was the cheapest) did that. Haven't got
a clue about later versions...
