This would depend on what aspect you mean.

If it is the transmission at the those frequencies under a certain wattage
as far as I am aware yes it is because it is a recognised standard and no
licence is required to use the gear. To bring in some form of restrictions
now would upset an awful lot of manufacturers but stranger things have
happened.

If you mean because people will be able to effectively browse the net
anonymously with little or no way of tracing them I am not so sure. Consume
do need a way to make sure that every user who uses it will be logged etc.
This is open to serious abuse if people are not careful. Having spoke to Kim
I think that they are aware of the problems with security etc but it is like
everything else remotely connected to the Web, there are always ways to
circumvent it.
