A contract is not legal just because you agree to it.  That is a basic 
principle of contract law.  You can challenge an unjust contract even if 
you signed it.

These EULAs have simply not been tested.  I have a nasty feeling, though, 
that if they go unchallenged for long enough then they may acquire a 
certain legal weight as standard practice.

But when you get one of those driver CDs with a sticker on the outside 
saying "Opening this container implies your assent to the license 
agreement" and the EULA is inside, that is simply illegal and doesn't 
stand.
