They will simply take a decision based upon their own experience of
dealing with staff who take more time off for sickness.
Presumably there is space for your to specify what the reason for the time
off was so they can see if it appears reasonable (ie, broken leg or
similar as opposed to hangover).

Neither should it be. It's only an EO matter if it's about disability in
this respect which is a different matter.

Why shouldn't the company do that?
Seriously the company is not a social security opportunity - they have a
business to uphold and if they decide they don't want to employ people who
are likely to need lots of time off that is their choice.
We all want employers to treat us reasonably. It does need to be a two way
thing.
