I agree with you but I think their argument is that the caveats for this
are buried too far into the small print. Maybe they're not being ripped
off in that they are getting the service they signed up for but there is
perhaps a valid call to have the advertising clearer.

It's not the connection speed he is complaining about, it's more that
his ISP didn't adequately explain that his line might not be up to it. I
have mentioned that is what the "up to" means but he said he thought
that meant "might not be constantly at the speed" rather than "well give
you the best we can up to that limit".

Personally I think he should've read the small print and I pointed out
that the capabilities of his line are not the responsibility of his ISP.
His - fairly valid - reposnse was that that it seems to be nobodies
responsibility in that whomever he talks to won't actually do anything
about it. I don't think his ISP has done anything but it does show that
the average punter is starting to consider what the adverts are actually
promising a little more. If this makes them think about unlimited
bandwidth adverts as well then so much the better.

Of course the real issue - for my friend - is that he blames his
connection speed for his apparent ineptitude on the Xbox. :o)
